DEFINITIONS                                                                                                                

"Luxe Boothie." means Luxe Boothie and its employees.

"The Client" means the person, organization, company or other body which is hiring the Equipment/s as specified on the Booking Form.                                                                                                            

"The Event Date" means the time and date of the event, confirmed by Luxe Boothie and noted on the Booking Form.                                                                                                                

"The Booking Form" means the form signed by, or on behalf of, the Client and Luxe Boothie specifying details of the booking.                                                                                                                

"The Deposit" means the Deposit specified in the Booking Form.                                                                                  

"The Equipment/s" means Luxe Boothie's photobooth equipment/s.     

"Day" means a calendar day unless specified otherwise.

 

BOOKING CONFIRMATION                                                                                                                    

A booking is not confirmed until the Client returns a Booking Form, pays any costs as outlined under ‘Payments’ in these terms and conditions, and receives confirmation of the booking from Luxe Boothie.

 

PAYMENTS                                                                                                                   

A non-refundable Deposit of $100.00 is payable upon booking. The booking is not confirmed until the Deposit is received by Luxe Boothie.                                                                                                                    

Payment can be made by bank transfer into our nominated bank account as stated on the issued Tax Invoice. Please ensure to include the invoice number in the description and email us a copy of the remittance advice.      

The remaining balance (final payment) of the booking cost is payable 30 days before the Client’s event.            

If the balance of the booking cost is not received more than 30 days before the event date, the booking will be canceled, and the Client will forfeit the Deposit.                                                                                                        

If the Client requests use of Luxe Boothie’s services in excess of the time noted on the Booking Form, this will be billed at $100.00 for each additional hour or part hour.

 

ACCESS, SPACE & POWER REQUIREMENTS                                                                                                                     

The Client shall ensure a safe and appropriate environment is provided for Luxe Boothie to operate its equipment.                                                                                                                    

The Client must ensure:                                                                                   

• a space of 3m x 3m or more                                                                 

• access to 240v power within 10m of Luxe Boothie’s equipment

• all doorways and access paths are at least 80cm wide if an outdoor event,

• an undercover area if any chance of poor weather                                                                                                  

A survey of the event location may be required if Luxe Boothie is not satisfied that a suitable location will be provided. This survey may incur an additional fee of $50.                                                                                               

The Client is responsible for paying any charges imposed by the venue, or required to access the venue. These charges may include but are not limited to, parking and electricity.

 

CHANGES AND CANCELLATIONS                                                                                                            

Requests for changes of the event date must be made at least 30 days before the original Event Date. A date change is subject to availability and receipt of a new Booking Form.

All cancellations will result in the Client forfeiting the Deposit, however, if Luxe Boothie is notified of cancellation more than 30 days before the event date, credit to the value of the Deposit will be given to the Client to use for any future booking made within 6 months of the date of cancellation.

Cancellations made within 30 days of the Event Date will result in the Client forfeiting all payments made to Luxe Boothie.

Luxe Boothie can cancel any booking at any time. If Luxe Boothie decides to cancel a booking, all payments made will be refunded to the Client.

 

RISK AND INSURANCE                                                                                                               

The Client will assume all risks and liabilities for and in respect of the Equipment/s and for injuries to or death of persons and damage to property howsoever arising from the possession or use of the Equipment/s. The Client indemnifies Luxe Boothie against the loss of or damage to the Equipment/s whether by fire, theft, accident, seizure, confiscation, malicious damage or otherwise, and will indemnify Luxe Boothie and hold Luxe Boothie harmless from all other losses, damages, claims, penalties, liabilities and expenses (including legal costs) howsoever arising incurred as a result of or in connection with the Equipment/s or the possession or use of the Equipment/s by the Client.                                                                                                             

As a result, any damage to the Equipment/s requiring a repair or replacement will be paid for by the Client to Luxe Boothie within seven (7) days of the Client receiving written notice from Luxe Boothie.

 

PRIVACY                                                                                                                      

Luxe Boothie agrees not to sell your details to any third party and will take reasonable measures to ensure that your details remain confidential. Luxe Boothie may contact you with future special offers and updates.

 

USE OF IMAGES                                                                                                            

The Client in agreeing to take up Luxe Boothie's services gives Luxe Boothie permission and rights for images taken while providing the services to be used on the website or social network site of Luxe Boothie and for Luxe Boothie’s advertising and promotional purposes. The Client also understands that Luxe Boothie takes no responsibility for people obtaining copies of the photos from the website or social network site.                            Luxe Boothie will not use images on their website or for advertising which are deemed unsuitable by Luxe Boothie and will not use any content that may be personally damaging to any person/s.

 

FORCE MAJEURE                                                                                                                      

Luxe Boothie will not be liable for failing to perform under this agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, internet outage or interruption of service, communication outage, failure by a service provided to us to perform, fire, threatened or actual act of terrorism, natural disaster, or war.

 

ATTENDANTS/STAFF MEAL                                                                   

Provision of meals for Luxe Boothie's staff is appreciated especially for events that are running for 4 hours or more.

 

MISCELLANEOUS                                                                                                                      

Luxe Boothie attendant/s may stop the usage of the Photo Booth at any time during the event if they feel that the Photo Booth is being misused in a way that is dangerous to any persons or potentially damaging to the product.

 

GOODS AND SERVICES TAX (GST)                                                                                                           

Luxe Boothie is registered for GST. All prices specified in the booking form are total price payable inclusive of GST.
